Agreement to These Terms
Welcome to InstaCheck. These Terms and Conditions explain the rules for using InstaCheck and related services. In these Terms, "we," "us," and "our" refer to the InstaCheck team, and "you" refers to the person using InstaCheck.
By creating an account, accepting these Terms, or using InstaCheck, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use InstaCheck.
What InstaCheck Provides
InstaCheck helps users scan, search, compare, review, save, and better understand products, ingredients, nutrition information, and possible compatibility considerations. Features may include barcode scanning, ingredient-label scanning, nutrition-label scanning, OCR, product search, product registration, product corrections, shared product records, AI-assisted ingredient and nutrition analysis, product scoring, nutrition scoring, personalized compatibility findings, product comparisons, favorites, scan history, recommendations, reviews, ratings, Reaction Journal, health reports, notifications, Premium features, referrals, streaks, leaderboards, and promotions.
Features may change over time. Some features may be experimental, unavailable, region-dependent, limited by configuration, Premium-only, or discontinued.
Eligibility and Accounts
You must be old enough to use an online service and create an account under the laws that apply to you. By using InstaCheck, you confirm that you meet the applicable age requirement and that the information you provide is accurate.
You are responsible for your account and for keeping your login credentials secure. You must not impersonate another person, create accounts for abuse, share access in a way that harms the service, manipulate app features, or attempt to bypass eligibility, Premium, referral, leaderboard, promotion, or security rules.
You may delete your account in the app. Account deletion may be irreversible and may remove access to account-linked information and features, including history, favorites, Premium status, referrals, leaderboard participation, reviews, notifications, and reaction records.
Health and Safety
InstaCheck provides general consumer and educational information only. It is not medical, dermatological, pharmaceutical, nutritional, allergy, toxicology, legal, or other professional advice. It is not a medical device or diagnostic tool.
Do not use InstaCheck as the sole basis for health-related decisions. Always read the physical product label and consult a qualified doctor, pharmacist, dietitian, dermatologist, allergist, or other professional before making decisions related to allergies, sensitivities, medical conditions, pregnancy, medication use, nutrition, skin reactions, product safety, or product suitability.
In an emergency or suspected allergic or adverse reaction, contact emergency services or a medical professional immediately.
Profiles and Personalized Findings
If you save allergies, sensitivities, medical considerations, lifestyle preferences, or avoid-list items, you understand that this information is self-reported and not verified by InstaCheck. Compatibility scores, warnings, profile matches, product recommendations, and explanations are informational aids only. They are not safety guarantees and do not mean that a product is safe, unsafe, recommended, medically appropriate, or free from risk.
AI-Assisted and Automated Information
InstaCheck may use OCR, automated systems, AI-assisted analysis, public product databases, search providers, and backend services to identify products, extract label text, classify ingredient risks, score products, assess nutrition information, summarize compatibility notes, generate explanations, enrich product records, find images, and support search.
AI-assisted, automated, OCR-extracted, third-party, and user-submitted information may be inaccurate, incomplete, inconsistent, outdated, or unsuitable for your circumstances. You are responsible for checking important information independently, including the physical product label.
Product, Ingredient, and Nutrition Data
Product, ingredient, package-size, photo, rating, review, score, and nutrition information may come from barcode databases, public sources, user submissions, OCR, AI-assisted extraction, backend processing, web search, or manual corrections. Product formulas, packaging, ingredients, nutrition facts, and warnings can change at any time.
We do not guarantee that any product record, ingredient list, nutrition label, risk classification, product score, compatibility analysis, recommendation, comparison, review, or rating is complete, accurate, current, or applicable to every package, region, or individual.
User Contributions and Shared Product Records
You may submit or correct product information, including product names, brands, barcodes, categories, product photos, ingredient lists, ingredient details, nutrition facts, package size information, ratings, and reviews. By submitting content to InstaCheck, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to use, store, reproduce, display, modify, distribute, and create derivative works from that content to operate, improve, protect, and promote InstaCheck.
Shared product information may be visible to other users and may be corrected, enriched, or combined with information from other users or sources. Do not submit private, confidential, sensitive, infringing, unlawful, misleading, abusive, or unrelated information into shared product fields or public reviews. Do not include personal medical details in shared product records or public reviews.
We may review, edit, hide, remove, restrict, or moderate user contributions at our discretion.
Reviews, Ratings, and Reaction Journal
Reviews and ratings may be displayed to other users and may be moderated, flagged, counted as helpful, hidden, deleted, or aggregated. Your reviews should reflect your honest experience and must not contain false claims, spam, harassment, medical misinformation, or content that violates another person's rights.
Reaction Journal entries and follow-ups are personal tracking tools, not medical records. You are responsible for the descriptions and images you upload and for avoiding unnecessary private information.
Premium, Billing, and Subscriptions
Some features may require Premium access, a subscription, or another paid entitlement. The app uses RevenueCat to support Premium purchases, restore purchases, and subscription status checks. Pricing, plans, trials, renewals, cancellations, taxes, and refunds may be handled by the applicable app store, RevenueCat, or platform payment provider.
Review the purchase screen and payment provider terms before buying. Unless required by law or the applicable payment provider's policy, fees may be non-refundable. We may change Premium features, pricing, or availability in accordance with applicable law and platform rules.
Referrals, Streaks, Leaderboards, and Promotions
InstaCheck may offer referral programs, streaks, leaderboards, promotional campaigns, rewards, or cash-prize promotions when enabled. Participation may require an active account, Premium access, leaderboard opt-in, valid referral activity, compliance with these Terms, and eligibility or anti-fraud checks.
We may disqualify users, withhold rewards, reverse credits, remove leaderboard entries, or modify results if we believe activity is fraudulent, automated, abusive, duplicate, ineligible, technically invalid, self-referred, or contrary to the purpose of the feature. Cash prizes or rewards, if offered, are conditional and subject to eligibility, verification, local law, tax rules, and any promotion-specific rules we provide.
Promotions are void where prohibited. You are responsible for any taxes, fees, reporting obligations, or legal requirements related to rewards or prizes. We may cancel, suspend, or modify promotions if technical issues, fraud, legal restrictions, low eligibility, or other circumstances affect fairness or operation.
Notifications and Communications
If you enable notifications, you may receive product updates, ingredient updates, warnings, account messages, referral updates, leaderboard updates, promotional messages, tips, announcements, and service notices. You can manage push notification permission through your device settings.
Acceptable Use
You agree not to misuse InstaCheck. This includes submitting false or harmful data, manipulating scores or shared product records, abusing referrals or leaderboards, attacking or disrupting systems, scraping at unreasonable scale, reverse engineering where prohibited, infringing intellectual property rights, harassing others, uploading malicious content, bypassing access controls, violating laws, or using InstaCheck for emergency, clinical, professional, or high-risk decision-making.
Intellectual Property
InstaCheck, including our software, designs, logos, interfaces, text, graphics, and non-user content, is owned by us or our licensors. We grant you a limited, revocable, non-exclusive, non-transferable license to use InstaCheck for personal, lawful purposes under these Terms.
Product names, trademarks, barcodes, logos, images, and third-party materials belong to their respective owners. Their appearance in InstaCheck is for identification, compatibility, product-information, and educational purposes.
Third-Party Services
InstaCheck relies on third-party services, which may include Firebase, Google services, Google ML Kit, RevenueCat, app stores, authentication providers, cloud providers, AI providers, product databases, image lookup services, and search providers. We are not responsible for third-party availability, data, content, policies, or practices. Your use of third-party services may be subject to their own terms and privacy policies.
Privacy
Our Privacy Policy explains how we handle information. By using InstaCheck, you agree that we may handle information as described in the Privacy Policy.
Suspension and Termination
We may suspend, restrict, or terminate access to InstaCheck if we believe you violated these Terms, created risk, abused features, manipulated promotions, infringed rights, submitted harmful content, or used the service unlawfully. You may stop using InstaCheck at any time and may delete your account in the app.
Changes to InstaCheck and These Terms
We may update, remove, pause, or change features at any time. We may also update these Terms from time to time. If changes are material, we may notify you in the app, by notification, or through another reasonable method. Continued use of InstaCheck after updated Terms take effect means you accept the updated Terms.
Disclaimers
INSTACHECK IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, QUIET ENJOYMENT, AVAILABILITY, AND RELIABILITY.
We do not warrant that InstaCheck will be uninterrupted, secure, error-free, medically accurate, nutritionally accurate, free of harmful content, or that product, ingredient, nutrition, AI, OCR, third-party, or user-submitted information will be complete, current, or reliable.
Limitation of Liability
To the maximum extent permitted by law, InstaCheck and its owners, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, punitive, health-related, lost-profit, lost-data, or reputational damages arising from or related to InstaCheck, even if we were advised that such damages were possible.
Nothing in these Terms excludes liability that cannot legally be excluded.
Indemnity
You agree to defend, indemnify, and hold harmless InstaCheck and its owners, employees, contractors, affiliates, and service providers from claims, losses, liabilities, damages, costs, and expenses arising from your misuse of InstaCheck, your user contributions, your violation of these Terms, your violation of law, or your reliance on InstaCheck contrary to these Terms.
Governing Law and Disputes
These Terms are governed by the laws of the Federal Republic of Nigeria, except where mandatory consumer protection laws in your jurisdiction require otherwise. Disputes will be resolved in the courts of Ogun State, Nigeria, unless applicable law requires another forum.
Severability
If any part of these Terms is found invalid or unenforceable, the remaining parts remain in effect. The invalid or unenforceable part will be limited or modified to the minimum extent needed to make it enforceable.
